How to Ask for a Lawyer – GJ Application

How-to-Get-A-Court-Appointed-Lawyer-for-Your-Child-Protection-Case-452-lssIt was a busy week for family court, with parents seeking parenting time. There was a sensitive parenting case involving a chronic but rare childhood disease called Diamond-Blackfan anemia. There are only 30 cases in North America. It’s hard to think of children who need at least two parents more desperately than those facing lifelong health struggles, but mom had to be encouraged to release pediatric appointment dates. Dad had been volunteering $500 – $1,000/month child support but stopped once excluded from parenting time. His actual child support will be $350/month. And I found the BC legal aid booklet called How to Make a Rowbotham Application in the Court registry.

Below is my first rough attempt to try to modify this criminal application for family court. New Brunswick (Minister of Health and Social Services) v. G.(J.). (1999) is a children’s aid case that actually mentions the Regina v. Rowbotham (1988) criminal case, and both these cases discuss the values of our Canadian Constitution, like liberty and security of person, that led to the first judge being asked to appoint a lawyer to replace legal aid. Then I found a copy of the actual publication on the legal aid website, called How to Make a GJ Application.

I first wrote about the landmark GJ case on this website in 2013, but I was unaware of the connection to the Rowbotham criminal case. The British Columbia Legal Aid publication states GJ can only be used in the Provincial Court of British Columbia and only in cases under the Child, Family and Community Service Act. But of course our Constitution applies to all courts and all laws. As we pause at the beginning of the new year to reflect, let’s hope we can extend the use of this application to create fairer child support and shared parenting.

2. The applicant wishes to retain counsel to maintain custody of their children. To that end, the applicant applied to the Legal Services Society for legal aid and legal aid has been refused.

3. The applicant cannot pay for a lawyer.

4. Representation of the applicant by counsel is essential to a fair trial and to the ability of the applicant to fully address these child protection concerns. The applicant believes the protection issues are serious and complex. The applicant is ______________years old and his/her level of education is______________________________.

5. The applicant relies on section 8(c) of the Family Court Rules (CFCSA).

6. The applicant also relies on Sections 7 and 11(d) and 24(1) of the Charter, and the common law.

7. Section 7 and 11(d) of the Charter guarantee the applicant the right to a fair hearing in accordance with the principles of fundamental justice and accordingly require funded counsel to be provided if the parent wishes counsel, cannot pay a lawyer, and representation of the parent by counsel is essential to a fair trial: New Brunswick (Minister of Health and Community Services) v. G.(J.), (1999), 3 S.C.R. 46.

8. Sections 7 and 11(d) of the Charter also guarantee the right to make full answer and defence.

9. The proper remedy is a stay of proceedings pursuant to Section 24(1) of the Charter until the necessary funding of counsel is provided.

There were 2 issues in G.(J.).: 1)The best interest of the child is paramount and presumed to lie within the parental home. 2)Section 7 rights to liberty, and security of person are so significant they are rarely overridden by other social interests. Effective parental participation at the [custody] hearing is essential for determining the best interests of the child in circumstances where the parent seeks to maintain custody of the child. Without the benefit of counsel, an unacceptable risk of error in determining the children’s best interests is created, thereby threatening to violate both the parent’s and his/her children’s s. 7 right to security of the person.

. . . I would have thought it plain that the right to nurture a child, to care for its development, and to make decisions for it in fundamental matters such as medical care, are part of the liberty interest of a parent ~ La Forest J. in the B.(R.) case.

G.(J.). at paragraph [60]For a restriction of security of the person to be made out, then, the impugned state action must have a serious and profound effect on a person’s psychological integrity. The effects of the state interference must be assessed objectively, with a view to their impact on the psychological integrity of a person of reasonable sensibility. This need not rise to the level of nervous shock or psychiatric illness, but must be greater than ordinary stress or anxiety.

G.(J.). at paragraph [61]I have little doubt that state removal of a child from parental custody pursuant to the state’s parens patriae jurisdiction constitutes a serious interference with the psychological integrity of the parent.

G.(J.). at paragraph [123] I agree with the Chief Justice that: “In proceedings as serious and complex as these, an unrepresented parent will ordinarily need to possess superior intelligence or education, communication skills, composure, and familiarity with the legal system in order to effectively present his or her case”.

The Canadian Constitution (Charter of Rights and Freedoms) says everyone has
the right to a fair trial.

In child protection matters, once someone has been denied legal aid, they have
the right to ask the court to appoint a lawyer to ensure they have a fair trial.

This request is called a “JG application.” JG is the name of a New Brunswick court
case (1999) about the right to have a lawyer in a child protection case..

Canadian courts create errors in determining the best interest of the child because of unfair trials without any ethical legal advice. These are devastating loses for any of us, which is why so many Canadians are seeking shared parenting arrangements.

Hier, aujourd’hui, et demain

Salut tout le monde, j’ai eu un grand week-end matchs de football à regarder. Dimanche soir ma mère m’a appelé pour me dire M. Sarkozy avait perdu son poste de président de la France. J’étais excité d’écrire mon post comparant M. Sarkozy à M. Harper. Je pensais que je pouvais avoir fini avant minuit, j’ai donc écrit: “Aujourd’hui, le projet de loi égalité des responsabilités parentales en France est mort avec le gouvernement Sarkozy.” Je n’étais pas trop inquiet quand je suis allé un peu plus de minuit, je pensais que personne ne dérange. Mais il l’a fait affecter la précision de mon message. Messages sur l’Internet sont souvent re-posté ou re-visité, année après année. Et chaque poste est daté, ce qui crée “circa” des données au moins. Mais cela a affecter la précision de mon message.

S’efforcer de garder leurs normes d’éthique et de haute précision, le journal The Boston Globe a fait une nouvelle règle: ils ne seront jamais utiliser les mots hier, aujourd’hui ou demain à nouveau dans une histoire de nouvelles. Au lieu de cela, ils vont indiquer le jour de la semaine. Voici la citation directe de l’articel expliquant leur position.

Yesterday, Today, and Tomorrow

Hi everyone, I had a great week-end watching soccer games. Sunday evening my mom called to tell me Sarkozy had lost his post as president of France. I was excited to write my post comparing Sarkozy to Harper. I thought I could have it finished before midnight, so I wrote, “Today the equal parenting bill in France died with the Sarkozy government.” I wasn’t too worried when I went a little past midnight, I thought no one would mind. But it did affect the accuracy of my post. Internet posts are often re-posted or re-visited year after year. And each post is dated, which creates “circa” data at least. But again, this did affect the accuracy of my post.

Striving to keep their standards of ethics and accuracy high, The Boston Globe newspaper has made a new rule: they will never use the words yesterday, today or tomorrow again in a news story. Instead, they will state the day of the week. Here is the quote directly from the article explaining their new position.

The reason for the change is that articles are no longer written only for the newspaper. Breaking news is posted immediately on the Globe’s websites; stories are then fleshed out, posted again, then put into the process for the next day’s paper and the next day’s web entries. With all that traffic, a reliance on “yesterday, “today,” and “tomorrow” is an invitation for error.

Unlike the editor’s note in this newspaper story, I am including the fact that I hope this website will exist indefinetely to help our children.

Given the importance of this schedule to the health and stability of children, families and our community and the loud outcry the School Trustee’s will again face if they scandalously and vexatiously change this schedule without sound empirical evidence, I would suggest to the Honourable Judges this schedule will last for some years and at least until air conditioning can be install for summer-long classes.

Further, I hereby remind all of Abbotsford Family Court’s approximately one dozen Honourable Judges that the Supreme Court of British Columbia, the Supreme Court of Canada, and well-established international law all state that it is generally in the best interest of children of divorce for the child to divide holidays equally between both parents, unless one of the parents is abusive.

Further, since the Honourable Provincial Court of British Columbia always does what is in the best interest of children, hopefully many families in Abbotsford can expect to see family court orders changing over the next 290 days to reflect the creation of this new Abbotsford holiday.

Convergence

Comment l’absence de père détruit notre société.

On dit que le Canada s’étend d’un océan à l’autre océan à l’autre l’océan … de l’océan Atlantique à l’océan Arctique à l’océan Pacifique. Et au Canada, il ya une convergence des esprits à travers le pays, et peut-être à travers le monde, d’aider les enfants.

La plupart des gens qui parlent ou écrivent sur le sujet d’aliénation parentale, ils peuvent vous raconter leur propre histoire sur ce sujet. Toutes les familles aliénées des pays francophones sont comme mes frères et sœurs dans la guerre contre l’aliénation parentale.

La chose la plus importante que je veux dire, c’est merci. Je tiens à vous remercier pour votre soutien. Ensemble, nous pouvons faire une différence.

J’ai commencé à écrire un article appelé Paversation, inspiré par ce qui semble être des milliers de blogs de maman là-bas, et surtout un controversée appelée momversation. J’ai un compte Twitter @ AbbotsfordPA appelé parce que je pensais PA pouvait se présenter pour Papa ou de l’aliénation parentale. Les 100 meilleurs blogs de maman pour 2011 sont ici. L’article qui s’appelle Maman on bouge, c’est ici. Il y avait aussi des centaines d’articles sur LinkedIn sur la façon dont les entreprises ont besoin d’une présence web constante et positive pour lutter contre leurs détracteurs. Cela est vrai aussi pour les parents et leurs enfants.

Mais sur ce samedi matin ensoleillé, j’ai été suivi par plus de côté trois intrigants parentales sites de sensibilisation aliénation. Un à partir d’un blogueur maman, l’autre d’un blogueur papa, et êtes-vous prêt pour cette … l’autre d’un blogueur enfant. Je pense que vous verrez une conjonction, une consolidation … une convergence.

D’abord le blogueur mère appelle à l’unité. Ensuite, le blogueur père appelle à la révolution. Puis l’enfant pleure pour la protection pour tous les enfants. Il s’agit de la vidéo intégrée ci-dessous. Très belle.

Dadurday

I started out to write an article called Paversation, inspired by what seems like the thousands of mom blogs out there, and especially a controversial one called Momversation. I have a Twitter account called @AbbotsfordPA because I thought PA could stand for Papa or Parental Alienation. The top 100 mom blogs for 2011 are here. There was also hundreds of articles on LinkedIn about how businesses need a constant and positive web presence to combat their detractors. This is true for parents and their children as well.

But on this Sunny Saturday morning I have been side tracked by three more intriguing parental alienation awareness websites. One from a mom blogger, one from a dad blogger, and are you ready for this… one from a child blogger. I think you will see a coming-together, a consolidation… a convergence.

First the mom blogger calls for unity. Then the dad blogger calls for revolution. Then the child blogger cries for protection. Brillant!

Good! Jean-Paul, so I can release the Round Table Report. The Senator will do as she will do. Obviously, Mr. Harper is only luke warm to equal shared parenting(ESP), but Senator Cools is one of the good guys and has been working towards ESP for the 14 years I have been involved. Bubbles of Love

Just like we have never had  Bubbles of Love  before in Abbotsford, it doesn’t sound like many french-speaking cities are familiar with Bubbles of Love either. But they have a wonderful way of referring to loved ones as little cabbages or little califlowers as in ma petite choufleur.  I found a utube video with a pregnant lady holding a cabbage by her navel and a pair of baby shoes with 50% written on each shoe. I have not found any utube videos on French Bubbles of Love Day, and ANCQ reports they have not heard any reports from their members about these events. We can all get our schools, our churches, our temples, our sports teams, our moms, and dads to stop what they are doing at noon on April 25 to blow some soap bubbles for at least 10 minutes. Also has anyone got a Panda costume? Maybe we should ask China?
